LDDS Privacy & Confidentiality Policy

The Law Department Efficiency DesktopSM and all software and documentation relating thereto (the "Desktop"), together with all components thereof, is owned by Law Department Desktop Services, LLC, a Virginia Limited Liability Company (herein “LDDS”) and protected by United States copyright, patent, trademark and other applicable laws and international treaty provisions.

Your company’s, firm’s and/or individual rights to access and use the Desktop and its components are limited by the terms and conditions of the applicable LDDS Customer License Agreement, LDDS Third-Party License Agreement and LDDS End User License Agreement, in addition to the terms and conditions of this Privacy & Confidentiality Policy.

By accessing and using the Desktop, our Customers and their authorized third-party and individual end users accept the terms and conditions of the above-referenced agreements and this Privacy & Confidentiality Policy.

Information Collected

In the course of providing Desktop Service to its Customers, LDDS acquires, stores and transmits information about its Customers and authorized third party and individual Desktop users that may be regarded as private or confidential. Any such information that LDDS collects, to include, without limitation, names, physical and email addresses, telephone numbers, information on corporate or firm officers or personnel, credit card information and numbers, status of accounts, account logs and the like, is done only for the purposes of initiating an account, Desktop implementation and training, billing, customer service, and improvement and management of Desktop-related services.

Your Choice

We do not collect personally identifiable information about you or any Desktop user without your knowledge, and all such information is collected directly from you. You are not required to provide us with this information, but if you choose not to, you may not be able to access and use the Desktop of the LDDS Customer that has authorized you to use it.

Privacy and Confidential Information

It is the policy of LDDS to respect the privacy of our customers and their authorized end users using the Desktop Service.

Except as specified herein, it is the policy of the LDDS not to reveal to third parties any information collected about our Customers or their authorized Desktop users without specific permission to do so and to use reasonable precautions to keep this information and data secure. However, any personal information that a Customer or authorized user places on a Customers Desktop is done at his/her own risk, and is therefore excluded from the above considerations.

LDDS partners with other companies to provide services on its behalf, such as Desktop hosting; implementing Customer Desktops; providing user training, support and help desk services; providing invoicing, accounts receivable and accounting services; or performing statistical analysis of our services. Such LDDS partners are required to maintain the confidentiality of your information and are prohibited from using that information for any other purpose.

Content of Information and Data

It is also the policy of LDDS to respect the confidentiality of information and data passed through or stored in the servers supporting the Desktop Service.

Except as specified herein, it is the policy of the LDDS not to reveal to third parties information or data uploaded by Customers and their authorized users to the Desktop without specific permission to do so and to use reasonable precautions to keep this information and data secure.

You acknowledge and understand, however, that LDDS does not exercise control over the content of the information or data passed through or stored in the Desktop servers; and that LDDS does not monitor, review, edit or take responsibility for any information or data created, accessed or disseminated through Customer use of the Desktop.

It is your sole responsibility to insure that any such information and data passed through and/or stored on Desktop servers is in compliance with all applicable laws, regulations, agreements with LDDS and this Privacy & Confidentiality Policy.

Government Requirements

Nevertheless, LDDS reserves the right to access, use, transmit, copy, adapt, publicly display and disclose any information; data; graphics, video and/or sound files, and other content created by, provided by, or accessed by Desktop users in order to comply with applicable laws and lawful government requests. This may also include disclosing Desktop customer and user names and other registration and identification information.

LDDS also reserves the right in its sole discretion to remove any content from its system in order to comply with applicable laws and lawful government requests. LDDS will fully cooperate with law enforcement authorities in the investigation of any suspicious or unlawful acts, and will report such acts, as required, accordingly.

You hereby authorize LDDS to disclose to third parties information you have provided, or information that LDDS has obtained about your account: (1) to agents of LDDS or its affiliates, such as independent auditors, consultants or attorneys as reasonable business practices require for the proper operation of the Desktop Service, using reasonable precautions to keep this information secure; and (2) to comply with government agency or court orders or requests.

Security

The security of information provided by LDDS Customers and their authorized users of the Desktop to LDDS is of utmost concern to us. LDDS exercises great care in providing secure transmission of information to and from your computers to the servers supporting the Desktop Service. Unfortunately, no data transmission over the Internet can be guaranteed to be 100% secure. Accordingly, while we strive to protect your information and data, LDDS cannot ensure or warrant the security of any information or data you upload or transmit.

LDDS also follows accepted industry practices to ensure the security of information and data stored on our system. To prevent unauthorized access, maintain data accuracy, and ensure the correct use of information, the servers supporting the Desktop Service utilize sophisticated physical, electronic and managerial procedures to safeguard and secure your information and data. However, you should be aware that no security measures are perfect or impenetrable. Accordingly, while we strive to protect your information and data, LDDS cannot ensure or warrant the security of any information or data you store on our system.

Passwords

We consider the email addresses and passwords you establish to access the Desktop highly sensitive information. Although LDDS takes precautions to prevent unauthorized use of the Desktop, you must also be careful to safeguard this access-related information. You are solely responsible for maintaining the secrecy of your password and any account information. LDDS will never ask you for your password in an unsolicited phone call or email.

Changes To This Policy

Since LDDS continually updates its services to LDDS customers, it may be necessary to change this Privacy & Confidentiality Policy over time to match the services we provide. As such, LDDS reserves the right to change this Policy at any time at its sole discretion. Any changes to this Policy will be described in future versions and posted here for Desktop user review.
